CardWally — Terms of Use

Welcome to CardWally. These Terms of Use ("Terms") govern your access to and use of the CardWally website and app (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. The Service

CardWally lets you create a digital business card, share it via a link or scannable code, add it to a mobile wallet, view scan analytics, and collect contact details from people who choose to share them. Features and availability may change over time.

2. Free service

The core Service — creating and sharing a card — is currently provided free of charge. Some features may be offered as optional paid upgrades; any charges will be shown clearly before you pay. We may change what is free or paid, or introduce, modify, or discontinue features, at any time.

3. Eligibility and accounts

You must be at least 16 years old to use the Service. You are responsible for the accuracy of your account information and for keeping your login secure. You are responsible for all activity that occurs under your account.

4. Acceptable use

You agree not to: use the Service for any unlawful, misleading, or fraudulent purpose; impersonate another person or misrepresent your affiliation; upload content that is illegal, infringing, defamatory, or harmful; collect or contact people's personal data without a lawful basis or their consent; send spam or unsolicited messages using data collected through the Service; attempt to disrupt, reverse-engineer, or gain unauthorised access to the Service; or use the Service to store or transmit malicious code.

5. Your content

You retain ownership of the content you add to your card (text, images, links). You grant CardWally a limited licence to host, display, and share that content solely to operate the Service (for example, showing your public card page to people who scan it). You are responsible for ensuring you have the rights to any content and logos you upload.

6. Data you collect from others

If you use CardWally to collect other people's contact details, you are responsible for complying with all applicable data protection laws, including obtaining any necessary consent and honouring individuals' rights. You agree to use such data only for lawful, legitimate purposes. See our Privacy Policy for more.

7. Third-party services

The Service relies on third parties such as Supabase, Stripe, and mobile wallet providers (Apple, Google). Your use of those features may also be subject to their terms. We are not responsible for third-party services.

8. Availability and changes

The Service is provided on an "as available" basis. We may modify, suspend, or discontinue any part of the Service at any time, and we do not guarantee uninterrupted or error-free operation.

9. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement. You use the Service at your own risk.

10. Limitation of liability

To the maximum extent permitted by law, CardWally and its operators will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Because the core Service is provided free of charge, our total aggregate liability to you is limited to the amount you have paid us (if any) in the 12 months preceding the claim, or €50, whichever is greater, to the extent permitted by law.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or use the Service unlawfully.

12. Governing law

These Terms are governed by the laws of Greece, and any disputes will be subject to the exclusive jurisdiction of the courts of Athens, without prejudice to any mandatory consumer protection rights you may have.

13. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and update the "Last updated" date. Continued use of the Service after changes means you accept the revised Terms.
